Welcome to Faith Inflatables! The terms “we,” “us,” and “our” refer to Faith Inflatables LLC, doing business as Faith Inflatables. Faith Inflatables operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Faith Inflatables is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
Screen settings and lighting can affect how product colors and appearance are displayed. This does not limit the product descriptions and express warranties applicable to your purchase, our Refund Policy, or your rights under applicable law.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. Faith Inflatables reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Faith Inflatables confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting. For cancellation requests, contact hello@faithinflatables.com with your order number. Cancellation and refund requests are subject to our Refund Policy and applicable law, including any rights arising from shipping delays. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Returns and exchanges are governed by our Refund Policy and applicable law.
Products may be purchased for personal, household, church, school, business, or community display. Purchases for resale or export require our prior written approval.
SECTION 4 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.
Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.
SECTION 5 - SHIPPING AND DELIVERY
Shipping destinations, charges, and estimated timing are described in our Shipping Policy and the information presented when you order. Preorder shipping estimates may be affected by production, freight, or carrier delays. If we cannot ship within the applicable promised time, we will provide the required delay notice and offer the choice to consent to the delay or cancel for a prompt refund of the unshipped merchandise, as required by applicable law. Where consent is required and is not obtained, we will cancel and refund as required by law. Contact hello@faithinflatables.com for help with a shipment that is missing or arrives damaged. Nothing in these Terms removes your rights under applicable consumer protection law.
SECTION 6 - INTELLECTUAL PROPERTY
The design of our 10-Foot Inflatable Jesus is patent pending. This identifies a pending patent application and does not represent that a patent has been granted.
Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Faith Inflatables, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.
You may use the website to learn about our products, make purchases for the uses described in Section 3, and obtain registration, warranty, and support services. These website-content restrictions do not prohibit the permitted display of a purchased product. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of Faith Inflatables, Shopify or any third party. Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Faith Inflatables.
Faith Inflatables's names, logos, product and service names, designs, and slogans are trademarks of Faith Inflatables or its affiliates or licensors. You must not use such trademarks without the prior written permission of Faith Inflatables. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.
SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials or third party sites, you do so at your own risk.
We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Faith Inflatables is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Faith Inflatables. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Faith Inflatables, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Faith Inflatables.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed in our Privacy Policy, and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.
Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you.
SECTION 11 - ACCURACY AND CORRECTIONS
We aim to keep product descriptions, prices, availability, and other website information accurate. We may correct errors or omissions. If an error materially affects an order you have placed, we will contact you before making a material substitution or charging a different amount. If we cannot fulfill an accepted order, we will notify you and refund payment for the unfulfilled merchandise as required by applicable law.
SECTION 12 - PROHIBITED USES
You may not use the Services for unlawful or fraudulent purposes, impersonate another person, submit information you are not authorized to provide, infringe intellectual property or privacy rights, send malicious software or unsolicited messages, attempt unauthorized access, or interfere with the operation or security of the Services. Products must be used for their intended display purpose and in accordance with the supplied instructions and safety warnings. Do not use a product in a way that conflicts with those instructions or disables its safety features. This requirement does not limit any warranty or consumer right that applies by law.
SECTION 13 - PRODUCT CARE, WARRANTIES, AND DISCLAIMERS
Follow the instructions and safety information supplied with your product, including directions for securing the inflatable, electrical connections, weather conditions, and storage. Contact our Support page if you need instructions or assistance.
The product warranty offered at the time of purchase, our Refund Policy, and applicable consumer rights continue to apply. Nothing in these Terms disclaims an express product warranty or any implied warranty that cannot lawfully be disclaimed, or makes an optional marketing subscription a condition of warranty service.
The website and optional online features are provided on an “as available” basis and may occasionally be interrupted or unavailable. We do not promise uninterrupted access or that every website feature will operate without error. This statement concerns website availability and does not remove our obligations concerning purchased products, refunds, or warranties. General website information does not replace the instructions supplied with the product.
The protections for express warranties, refunds, and mandatory consumer rights in this section also apply to the general disclaimers in Sections 2, 7, 8, and 9. No general disclaimer in these Terms overrides a right or remedy that cannot lawfully be excluded.
SECTION 14 - LIMITS OF LIABILITY AND CONSUMER RIGHTS
To the extent permitted by applicable law, Faith Inflatables LLC is not liable for indirect or consequential losses arising from use of, or inability to access, the website. This limitation does not exclude liability for fraud, willful misconduct, gross negligence, personal injury, defective products, or any other liability that cannot lawfully be excluded or limited. It does not limit our obligations under an express warranty, our Refund Policy, or applicable consumer protection law. Where a limitation in these Terms is not permitted, it applies only to the extent permitted by law.
SECTION 15 - INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify Faith Inflatables LLC and its officers and employees against third-party claims, damages, and reasonable legal costs, but only to the extent caused by your unlawful conduct, your infringement of another person's rights through content you submit, or your intentional or negligent misuse of a product contrary to its supplied instructions and safety warnings.
This obligation does not cover claims to the extent caused by a product defect, inadequate instructions or warnings, our negligence or misconduct, our breach of these Terms or a warranty, or any matter for which applicable law does not permit us to obtain indemnification. It does not require you to indemnify us for bringing a good-faith warranty, refund, safety, or consumer complaint.
We will give reasonable notice of a claim for which we seek indemnification and a reasonable opportunity to participate in its resolution. We will not agree to a settlement that imposes a payment, admission, or other obligation on you without your written consent. Recoverable amounts must be established by a final judgment or a settlement you approve in writing. This section does not impose a separate duty to fund our defense in advance.
SECTION 16 - SUSPENSION AND TERMINATION
We may restrict or suspend access to website features when reasonably necessary to address fraud, misuse, a material breach of these Terms, or a security concern. A suspension does not cancel our obligations for accepted orders, refunds, warranties, or rights that survive under applicable law.
SECTION 17 - SEVERABILITY AND AGREEMENT
If a provision of these Terms is held unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a provision is not a waiver of the right to enforce it later. These Terms and the policies they reference govern your use of the Services. Specific product warranties and mandatory consumer rights take priority over conflicting general language in these Terms.
SECTION 18 - GOVERNING LAW
These Terms are governed by the laws of the State of California and applicable federal law. This choice does not deprive a consumer of mandatory protections available under the laws that otherwise apply to that consumer. These Terms do not require arbitration or waive access to small claims court.
SECTION 19 - CHANGES TO THESE TERMS
We may update these Terms by posting a revised version with an updated date. Changes apply prospectively. They do not retroactively reduce the warranty, refund, or other rights applicable to an existing purchase. Where additional notice or consent is required by law, we will provide it or obtain it.
